NCDRC issues notice to Lodha Developers
The National Consumer Disputes Redressal Commission (NCDRC) has issued notice to Ms Lodha Healthy Construction and Developers Pvt Ltd in Hyderabad and has asked it to file a written reply within one month, to a host of grievances and deficiencies pointed out by its customers who formed Bellezza Apartment Owners Welfare Association. The petition was admitted by a bench headed by Justice Ajit Bharihoke. The bench has sought a detailed reply for each of the allegations. The notice to the builder was issued under section 13 (2) of the Consumer Protection Act, 1986. The bench said, “If you fail to do so, we will close your right to file a written reply.” According to the petitioners, the builder promised 'California model' flats in Bellezza Towers at Kukatpally and collected huge amounts. The standard of the towers and its flats are nowhere near the promised specifications, Ashish Dholakia, the counsel for the flat owners, said. Since the project did not meet fire safety norms, the fire department refused to renew fire licence. The builder has also built another project called Meridian Towers by cutting into the parking space of Bellezza. He alleged that the builder misled both the customers and the GHMC. As against the original 592 flats, Lodha built 360 with an assurance that the unused space would be left to the Bellezza owners for common use. But later the builder came out with Meridian Towers that ate into the common space of Bellezza. Gautam Bajaj and Dishit Bhattacharji, the two advocates who took the matter to the national panel, informed, “We sought a compensation of Rs 300 crore for the loss and mental trauma the customers suffered.”
