Gera clarifies his stand to Realty+ on the Godrej suit

On Tuesday 16th April 2019, Gera Developments Pvt Ltd had contested in a Pune district court, Godrej Properties Ltd’s use of the term ‘ChildCentric’ for promoting its project at Noida as a trademark infringement. It was pointed out in the suit that Gera had registered the trademark in 2008. Rohit Gera when speaking to Realty+ said, “The term ‘ChildCentric’ was coined by us and is exclusively used to describe multiple Gera projects. In addition, huge investments have been made to build the profile, in contrast to Godrej Nurture’s ChildCentric being only about providing certain amenities. Hence in this regard, the time, effort and finances went into building the ‘ChildCentic’ brand image can rightfully only be attributed to Gera Developments Pvt Ltd.”  He further added, “The term ‘ChildCentric’ has a certain significance to projects constructed by Gera developments Pvt Ltd and hence when it is used by another entity in any other context it has a diluting impact and effect of the brand in the minds of the audience.”  When Realty+ contacted Godrej Properties Ltd, Ajay Pawar, AVP, Head Corporate Communications, Godrej Properties Ltd stated, “We have not been served with any such notice. We respect all valid trademarks and will look into this matter and seek a suitable resolution.”
