The district administration on Tuesday seized two properties of 3C Developers to recover Rs 34 crore from the realty firm to pay off buyers in Lotus Panache project in Sector 110, as ordered by the country’s top consumer court. The developer, however, claimed it has handed over the properties as “security deposit” till the case is resolved.
The order by the National Consumer Disputes Redressal Commission (NCDRC) relates to a plea filed by Lotus Panache Welfare Association against the builder for delaying the possession of the housing project and non-payment of compensation for the delay.
Durgesh Singh, deputy tehsildar of Dadri, said, “The commission heard the case and issued a recovery certificate of Rs 34 crore against the developer. The administration had issued a notice to the developer for payment of dues on October 27. They ignored the notice and also failed to clear the dues.”
“So, a team from Dadri tehsil confiscated the two properties in Sector 127. These under-construction sites are spread over 1,000 sq m and 5,625 sq m, respectively. These properties will be auctioned to recover the dues,” he added.
The Lotus Panache project was launched in 2010 in Sector 110. It comprised of 30 towers having 4,000 apartments and was supposed to be delivered by 2012. However, only 1,000 flats have been handed over to buyers till date.
A spokesperson for 3C Developers said the company has filed a review petition in the Commission. “The case has reopened for hearing and matter is sub judice. We honour the Commission’s decision and the homebuyers. But we have given the two properties to the administration ourselves as ‘security deposit,” he told media.
When contacted, district magistrate BN Singh said the administration “is taking strict action against all defaulters”.
“We are conducting property attachment exercises against all the developers against whom recovery certificates are issued. We will ensure that all the defaulters pay the dues as per the law,” he said.
