FIR registered against Navi Mumbai builder for forgery
The Nhava Sheva police have registered an FIR based on a complaint lodged by Vashi-based realty firm, Regal Habitat Pvt Ltd, alleging that two developers from Sanpada in connivance with the chairman of Sir Mohammad Yusuf Trust and others have indulged in cheating and forgery to usurp around 80 acres
The Nhava Sheva police have registered an FIR based on a complaint lodged by Vashi-based realty firm, Regal Habitat Pvt Ltd, alleging that two developers from Sanpada in connivance with the chairman of Sir Mohammad Yusuf Trust and others have indulged in cheating and forgery to usurp around 80 acres of the trust’s land at Wahal in Panvel Taluka.
The realty firm had an assignment deed agreement of August 2007 for the said land.
The accused named in the FIR are developers Bhupendra Shah, Kiran Dand, trust chairman Harun Yusuf, and Karjattalathi Ramesh Bhalerao.
The other accused are Wajir Khan, who is the director of M/s Fern Scape Properties, his aide Suresh Shendge and others. All the accused have been booked for cheating and forgery on Monday.
Complainant Vikram Bhanage (28), who works with Regal Habitat, has stated in the FIR that the key accused, Bhupendra Shah, has forged an ante-dated sale deed agreement with the trust dated July 1995, thus claiming property ownership prior to the realty firm and had even obtained a ‘fake’ farmer certificate from the tehsildar office at Latur and purchased the trust’s farmland in Wahal for Rs 4 lakh.
Addressing a press conference, Bhanage said, “Upon learning about the conveyance deed of the Wahal land between Bhupendra Shah, Kiran Dand and Sir Mohammad Yusuf Trust, we approached the Panvel court in 2011 claiming our firm’s ownership rights. Bhupendra Shah too submitted his documents in the Panvel court claiming his rights.”
Bhanage further said, “The sale deed agreement of a land at Kuntegaon in Latur purchased by Bhupendra Shah and two others Ratanlal Wadhwa and Harilal Hinduja on September 3, 2007 was registered with the sub-registrar at Latur. But, it was revealed that photographs and signatures of Bhupendra Shah on the Latur land’s sale deed in September 2007 and Wahal land’s deed of conveyance in April 2008 were different. Hence, by misusing a namesake, Bhupendra Shah and others submitted forged documents in the Panvel court for claiming ownership rights of the Wahal land that was actually leased out to our firm by the trust.”
Later, in May 2015, Shah sold the Latur land to RahibaiGawali so that his fake farmer certificate was not exposed, Banage added.
Shah registered the sale deed agreement of the Latur land and submitted a fake election identity card which has the photograph of some other person with a different signature as Bhupendra M Shah, Banage said.
Bhupendra Shah, who is based in Navi Mumbai, refuted the allegations. “I will file a defamation case against those publishing false news reports about me without verifying the facts of the property dispute as it is sub-judice,” Shah said.
Senior inspector Chetan Kakade of Nhava Sheva police station said, “We will conduct an in-depth probe by verifying the property documents as the land dispute is more than a decade old. We will also be verifying the three namesakes of Bhupendra Shah in the alleged forged documents as they are namesakes of a renowned builder in Navi Mumbai as alleged by the complainant. Hence, only after ascertaining the facts will legal action be initiated against the accused persons.”
Kakade said, “On Wednesday, we had summoned the Karjattalathi Ramesh Bhalerao, who is one of the accused and have recorded his statement. Bhalerao was a witness in signing the sale deed agreement of land purchased by Shah in Latur as that land was owned by Bhalerao’s father-in-law. The other accused will also be summoned.”
