The Gujarat high Court issued notice to the Gujarat state government directing it to set up a regulatory authority under the Real Estate (Regulation and Development) Act, 2016 on a PIL filed by social activist Chhagan Mevada. Hearing the petition, a division bench of Chief Justice R. Subhash Reddy and Justice V. M. Pancholi has also made the state Urban Housing and Urban Development Department respondent to the PIL.
The rules and regulations under the RERA were notified by the Gujarat state government on 5th May, but the petition said that the state government hasn’t yet set up the regulatory authority contemplated under the RERA with which every new housing project is supposed to be registered.
The petition further stated that the regulatory authority under the Act is required to check if the builder has the capacity to complete the project in the given time and this will stop unscrupulous practices like taking advance money from flat buyers and not completing the project within promised time.
