Rajasthan RERA seeks state nod to make registration mandatory

To control the unregulated property dealers’ functioning, the Real Estate Regulatory Authority (RERA), Rajasthan has sent a proposal to the state government seeking permission to make RERA registration mandatory. The proposal has been mooted to bring more transparency and professionalism in the sector. As per the RERA Act, to safeguard interests of consumers, registration of property consultants is mandatory, and they cannot facilitate sale or purchase any plot, apartment or building without obtaining registration. “Once, it becomes mandatory, RERA will take legal action against property dealers who operate without registration. This would safeguard the rights of the consumers,” said an UDH official. He added, “After registration is done, the agents and dealers will be provided with a number that they would have to mention on their visiting cards.” Almost one-and-half years after the Real Estate Regulatory Act (RERA) was enacted, buyers still do not have a clear roadmap and builders continue to sell them distant dreams in absence of full-fledged regulations. The RERA was introduced with an aim to bring more transparency in the existing system and protect the interests of homebuyers. An official said, “Across the state many agents have registered under RERA. However, there are several who are still not registered and are working as agents.” Officials at RERA said that constitution of RERA, authority and appellate tribunal is pending and hearing of the cases can only start after January. “The aggrieved buyers can register their complaint along with related documents at RERA. On the basis of the complaint, notices would be issued to the respondents. If no reply is filed, RERA can take immediate action. However, in a scenario where reply is filed, both the parties will have to wait for the hearing date,” said a RERA official. Recently, RERA proposal to constitute permanent appellate tribunal received the Election Commission (EC) steering committee’s nod. An official said, after the model code of conduct came into effect as per mandatory provision the proposal was forwarded to EC to constitute RERA, authority and appellate tribunal.
