Patiala consumer forum directs Emaar MGF Land to refund money to homebuyer

As a private land developer failed to hand over the possession of a plot bought in 2007, the consumer forum has ordered a complete refund of money along with interest to the owners. The Patiala consumer forum asked Emaar MGF Land to refund Rs 34,46,604 to complainant Sheena Puri along with interest at the rate of 12% per annum from the respective dates of deposit till realisation and also a compensation of Rs 40,000 on account of mental agony and harassment suffered by the complainant, including litigation expenses within a period of 30 days. As per the forum orders, Sheena Puri's father Ashok Dewan had agreed to purchase a plot from the land developer in their project 'Augusta Greens' at Mohali Hills, Sector 109, SAS Nagar. He paid Rs 10,35,000. On May 2007 he got a provisional allotment letter for a plot measuring approximately 300 square yards the total sale consideration of which was Rs 34,50,000. Thereafter, Dewan signed a buyer's agreement on June 20, 2007 as per which the possession of the plot was to be handed over to the buyer in three years. As per the complaint, Dewan paid a total of Rs 36,19,104 to the developer by February 4, 2009. He passed away in December 2009 following which the property was transferred in the name of his daughter Sheena Puri in November 2011. However, until June, this year, the possession of the plot was not handed over to the complainant. It was learnt that the plot could not be handed over to the complainant as the land had not been acquired by the land developer from the local farmers. The complaint claimed that other than refunding Rs 34,46,604, along with the interest, a penalty of Rs 14,40,000 at the rate of Rs 50 per square yard should also be paid to her.
