MahaRerainstructs Skyline Construction to repay for late possession

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed developer Skyline Construction Co, part of the RNA Group, to refund a sum of Rs 1.06 crore, along with 10.55 per cent interest and stamp duty of Rs 6.65 lakh, to Bollywood actor VrajeshHirjee for delayed possession of a flat in the RNA Exotica project in Goregaon. Hirjee, who has starred in several Bollywood films like the Golmaal series, had booked flat C 2804 in RNA Exotica, near Ram Mandir station, in 2011. He had sought a refund under Section 18 of RERA due to delays in completion of the project. He was promised possession on December 31, 2015. During the hearings, advocate SubitChakrabarti, appearing for Skyline Construction, pleaded not guilty and contended that the complaint was not maintainable as there was no agreed date of possession in the registered agreement. He also contended that other allottees from the project had filed a suit in the Bombay High Court and the construction was progressing under HC monitoring towards a possession date of October 31, 2019. Therefore, Hirjee’s complaint was premature, he claimed. He also blamed delays in obtaining clearances from environment department, and Airports Authority of India and MMRDA for not completing the project.
