The state prosecution on Wednesday opposed the application of over 40 buyers, demanding possession of plots in a D S Kulkarni Developers Limited’s project at Phursungi. Special public prosecutor Pravin Chavan filed a say before the special MPID judge A S Bhaisare stating that these plots were created on the basis of false and fabricated layout though the land was mortgaged with the Credestrial trusteeship company against the debentures raised. The prosecution in its say opposed the application on the grounds that the property had been mortgaged, and the layout plan prepared by Kulkarni and others was false and fabricated. The application filed was not maintainable and the court had no jurisdiction to decide the rights of the parties under the Specific Relief Act, the prosecution said, praying to dismiss the application.
