Land lease of Indore's Sayaji hotel may be terminated

The Indore bench of Madhya  Pradesh high court on Monday upheld lease termination order passed by Indore Development Authority against Sayaji hotel for flouting land use norms. Justice SC Sharma dismissed the petition filed by hotel challenging detailed resolution passed by IDA board on December 20, 2017. The court looked into previous litigation regarding the matter and considered earlier two orders passed by the high court in the cases. The first writ petition had been filed by the hotel when IDA had issued a show cause notice in 2007 and in 2015 had decided the issue of lease cancellation without hearing the petitioner company. In second writ petition filed by the hotel, they had challenged IDA CEO’s authority to issue a show cause order, arguing that IDA board was competent to pass such an order. The court allowed this petition and directed IDA board to consider the issue.
