Karnataka HC issues guidelines to BBMP for demolitions

The Karnataka HC has issued a series of guidelines to the BBMP on Tuesday which must be followed while undertaking demolitions. The civic agency was told not to carry out demolition of a building without recourse to Section 462 of the KMC Act, 1976, which says reasonable time should be given to the property owner to file his/her reply.

The High Court said the name and address of the owner/khatedar should be mentioned in the notice/provisional order henceforth. Also, the property's boundary should be delineated in an unambiguous manner and the Palika must record specific findings regarding alleged deviations. All notices and orders should be served strictly in accordance with the law, the high court said.
