Justice A Rajashekher Reddy of the Hyderabad High Court on Wednesday vacated the restraint order that was passed earlier by a single judge and allowed the Telangana government to go ahead with its two-bedroom housing scheme for the poor at Necklace Road. The state can go ahead with the construction of houses, but this will be subject to the result of the final outcome of the writ petition in question, the judge said while vacating a status quo order. The judge pronounced this order after hearing the argument of the state counsel who urged the court to vacate the restraint order in view of the public purpose involved. Three months ago, the court had passed the status quo order after hearing a petition filed by M Jagannath Singh and nine others of Bholakpur, near Sanjeevaiah Park, at Necklace Ro ad. The petitioners wanted the state to pay them compensation as per the Land Acquisition Act, 2014. Their plea was opposed by the state which claimed that the land in question was government land. The state counsel, showing a notification issued by the state in 1990 notifying the area measuring 2,780 square yards as a slum, said there was no need to acquire the land at all. The judge said that he would decide in the final hearing whether the petitioners are entitled to compensation.
