High Court Refuses to Unseal 1,060 flats in Greater Noida
In a major blow to Real Estate developer Supertech, the Allahabad High Court on Wednesday refused to unseal 1,060 illegally-constructed flats in a housing project in Uttar Pradesh’s Greater Noida. The said projects were sealed following a court order passed a fortnight ago. The builder had made the request to unseal the 1,060 flats in “Supertech Czar Suites” which have been sealed following the order dated April 20. PTI reported that a division bench comprising Chief Justice D B Bhosle and Justice Yashwant Varma declined to unseal the project. However, the bench also directed the Uttar Pradesh government to decide, by the next date of hearing on July 10, the builder’s appeal against an order of the Greater Noida Authority. The authority had turned down an application seeking regularisation of the illegally-constructed flats. The flats were sealed after plea by V K Sharma and seven other flat buyers, who contended that the builder, despite having clearance of only 844, went on to construct a total number of 1904 flats. A number of projects from the builder have faced legal trouble. In March, hearing a case against an another project from builder, the Supreme Court had warned that two of its 40-storey residential buildings will be demolished if they are constructed without a proper sanction, according to PTI. “The buildings, if built without a proper sanction, will be demolished,” a bench comprising Justices Dipak Misra and A M Khanwilkar said. It was hearing pleas against the Allahabad High Court’s April 11, 2014 verdict ordering demolition of the two 40-storey residential twin towers –Apex and Ceyane — in Noida and directing Supertech to refund money to homebuyers with 14 per cent interest in three months.
