HC orders sealing of flats in Greater Noida

The Allahabad High Court has directed the Greater Noida Authority to seal all illegal flats in Supertech’s Czar housing project located in sector Omicron. The Bench comprising Chief Justice D.B. Bhosale and Justice Yashwant Varma passed the order on Tuesday while hearing a petition filed by V.K. Sharma and eight other residents of Czar society. “We direct the respondent authority (Greater Noida Authority) to seal all the excess flats constructed by the respondent- developer,” said the order. The court said, “We have perused the undertaking on affidavit given by the respondent - developer. We are not satisfied with the same. It does not give the correct facts and figures in respect to the flats already allotted to the buyers or how many flats have not been allotted. Counsel for the developer seeks further time to file an additional affidavit on May 2, 2017.” On February 22, the Greater Noida Authority had sealed illegal villas and few flats in the Supertech’s Czar housing complex in sector Omicron. The court had taken cognizance of a plea by home owners alleging that the real estate major had built over 1,000 residential units in violation of sanctioned building plans. “The Greater Noida authority did not implement the high court order. We raised the issue during the hearing how the Greater Noida Authority sealed only a few flats to the relief of the builder. The HC took the matter seriously and expressed dissatisfaction with the authority action. The court once again has directed the authority to seal all illegal flats. We hope now the authority will implement the HC order,” said Mr. V.K. Sharma.
